Right of withdrawal for custom-made products

Uryan Modular eurorack cases and 19” audio racks are made to order. We do not sell standard prefabricated products from general stock, except for specifically marked in-stock prototypes or demonstration units, if available.

Each custom case or rack is manufactured according to the parameters selected by the customer. These parameters may include, among others: size, type, colour, finish, power supply configuration, rail colour, layout and other individual requirements.

For this reason, these products are non-prefabricated goods made according to the customer’s instructions, individual choices or express request.

Please note that the 14-day right of withdrawal without giving any reason does not apply to such custom-made products.

The legal basis under Hungarian law is Section 29(1)(c) of Government Decree 45/2014. (II. 26.), which states that the consumer may not exercise the right of withdrawal in the case of:

“non-prefabricated goods made on the basis of the consumer’s instructions or express request, or goods clearly personalised for the consumer” [1]

This means goods that are not prefabricated and are produced according to the consumer’s instructions or express request, or goods that are clearly personalised for the consumer.

This rule is also based on EU consumer law. Article 16(c) of Directive 2011/83/EU excludes the right of withdrawal for:

“the supply of goods made to the consumer’s specifications or clearly personalised” [2]

Article 2(4) of Directive 2011/83/EU defines:

“goods made to the consumer’s specifications” means non-prefabricated goods made on the basis of an individual choice of or decision by the consumer [3]

The Court of Justice of the European Union confirmed in Case C-529/19 that this exception applies regardless of whether the trader has already started manufacturing the goods:

“irrespective of whether the trader has begun to produce those goods” [4]

Important: this notice applies only to the 14-day right of withdrawal without giving any reason. It does not limit or exclude any statutory warranty, product liability or guarantee rights that may apply if the product is defective, damaged, or does not conform to the agreed specification.

Elállási jog egyedi rendelésre készülő termékek esetén

Az Uryan Modular által készített eurorack case-ek és 19” audio rack-ek egyedi rendelés alapján készülnek. Nem árulunk általános raktárkészletről, előre gyártott termékeket, kivéve az esetlegesen külön feltüntetett, készleten lévő prototípusokat vagy bemutatódarabokat.

Minden egyedi rendelésre készülő case vagy rack a vásárló által kiválasztott paraméterek alapján kerül legyártásra. Ilyen paraméterek lehetnek többek között: a méret, a típus, a szín, a felület, a tápellátás / power supply konfiguráció, a sínek színe, az elrendezés és egyéb egyedi igények.

Ezért az ilyen termékek nem előre gyártott árunak minősülnek, hanem a vásárló utasítása, egyedi választása vagy kifejezett kérése alapján készülnek el.

Felhívjuk vásárlóink figyelmét, hogy az egyedi rendelésre készülő termékek esetében a fogyasztót nem illeti meg a 14 napos, indokolás nélküli elállási jog.

Ennek jogalapja a 45/2014. (II. 26.) Korm. rendelet 29. § (1) bekezdés c) pontja, amely szerint a fogyasztó nem gyakorolhatja a 20. § szerinti elállási jogát:

„olyan nem előre gyártott áru esetében, amelyet a fogyasztó utasítása alapján vagy kifejezett kérésére állítottak elő, vagy olyan áru esetében, amelyet egyértelműen a fogyasztó személyére szabtak” [1]

A szabály összhangban áll az Európai Unió fogyasztóvédelmi szabályozásával is. A 2011/83/EU irányelv 16. cikk c) pontja szerint az elállási jog alóli kivétel vonatkozik az alábbi esetre:

“the supply of goods made to the consumer’s specifications or clearly personalised” [2]

A 2011/83/EU irányelv 2. cikk 4. pontja szerint:

“goods made to the consumer’s specifications” means non-prefabricated goods made on the basis of an individual choice of or decision by the consumer [3]

Az Európai Unió Bírósága a C-529/19. számú ügyben megerősítette, hogy ez a kivétel attól függetlenül alkalmazható, hogy a gyártó ténylegesen megkezdte-e már a termék előállítását:

“irrespective of whether the trader has begun to produce those goods” [4]

Fontos: a fenti tájékoztatás kizárólag a 14 napos, indokolás nélküli elállási jogra vonatkozik. Nem érinti a vásárlót megillető jogszabályi kellékszavatossági, termékszavatossági vagy jótállási jogokat hibás teljesítés, sérülés vagy a megrendelt specifikációtól eltérő teljesítés esetén.
